Member News: Sabrina Pacifici Profiled in Law Practice

Just as James Brown was the hardest working man in show business, Sabrina Pacifici is the hardest working woman in legal research. In addition to her day job, Sabrina publishes LLRX, a monthly legal research and legal technology Webzine, and beSpacific, a daily legal resources blog that has become a must read for many in law and government. After ten years of LLRX and three years of beSpacific, Sabrina received a well-deserved four page profile in the December 2006 issue of Law Practice. Most interesting is the interview in which Sabrina discusses the origins of LLRX and refutes the lawyers as technology laggards stereotype.

Howell and Kinard Get New Gigs; Become Your Own Private Eye Thanks to Levitt

In July, we reported that Reed Smith had fired prominent blogger and TechnoLawyer member Denise Howell (she coined the word "blawg"). I'm pleased to report that Denise has a new gig — several actually. ZDNet has hired her to pen the legal blog Lawgarithms, and Leo Laporte of TechTV and TWIT fame has hired her to create a podcast called TWIL (This Week in Law). In addition, Denise continues to write her personal blog and record the Sound Policy podcast at IT Conversations.

Longtime TechnoLawyer member Lewis Kinard has assumed the title of CEO and General Counsel of Practice Manager Group, developer of Practice Manager, a soup-to-nuts case management solution. Kinard previously served as the company's COO. Kinard's story is similar to that of Victor Kiam — he liked the product so much, he joined the company.

Finally, TechnoLawyer member and law firm trainer extraordinaire Carole Levitt of Internet for Lawyers has published the latest edition of Cybersleuth’s Guide to the Internet, which explains how to use the Internet to investigate just about anything — from digging up dirt to impeaching someone's credibility to finding missing people, property records, political party affiliations, unlisted phone numbers, cell phone numbers, and much more. Daniel Schultz Leverages Technology to Recover More than $120 Million for His Client

On May 16, 2005, a jury found that seven insurance company defendants owed the State of California their respective liability insurance policy limits, totaling more than $28 million, for failing to pay a covered Superfund liability claim. That jury verdict came on the heels of settlements with other insurance company defendants, both before and during trial, of more than $120 million.

For this complex trial, solo practitioner and veteran trial lawyer Daniel Schultz of Tempe, Arizona teamed up with large firms Anderson Kill & Olick and Cotkin Collins & Ginsburg.

Dan credits much of his success at trial to his ability to leverage technology. "These tools help me to save lots of time, making me a more effective advocate," said Dan. "TechnoLawyer helps me find these solutions," he added.

So which tools did Dan use? "I used CaseMap to create a comprehensive trial database, LiveNote to search deposition testimony, eFax Plus for virtual faxes, and a Nextel BlackBerry 7510 for real-time communications with paralegals and other support people back in our war room."

Thanks to holding the trial in a forward-thinking city, Dan had WiFi access in the courtroom. "The city of Riverside has a free WiFi service in the downtown area — I was able to get a signal in the courtroom," he noted. "I used it during trial to conduct Google searches relating to the defendants' expert witnesses, other research, and also communicate with the rest of the trial team members."

He also noted the importance of a modern hotel. "I stayed at the Marriott Riverside, which had high-speed Internet access. I used it to communicate with witnesses, who needed to be apprised of when they needed to travel to Riverside for their testimony."

In recounting his experience, Dan provided a number of other technology tips, including these:

"I had an HP i450 portable ink jet printer with me to print out witness examination outlines, my opening statement, closing statement outlines, trial graphics, etc., which I would draft in the evening and then print out.  No worry about not being able to get my work product printed out in the morning, as I had it right there with me in the hotel room.

"I had a portable Ambir Visigo 600 dpi scanner to scan documents used to create trial graphics.

"I took all my software CDs with me in CD holders just in case Murphy's law kicked in and I needed to re-install any of my software (thankfully, that did not happen).

"The team used a 'trial jockey' who employed Trial Director to display our trial graphics for our opening arguments and closing arguments and video deposition testimony for witnesses who could not testify live and for cross-examining witnesses.  We also used an ELMO camera for displaying other documents."

So, is Dan relaxing now that the trial has ended? Far from it. "The case is not yet over, as we now have the right to proceed on bad faith claims against the remaining defendants against whom we received the favorable jury verdict," Dan observed. Litigation Expert Shares His Secrets

Jason Havens Appointed by Governor Bush to ABLE Trust

TechnoLawyer member Jason Havens is everywhere these days. Hot on the heels of his TechnoFeature article in which he reviewed PracticeMaster and Tabs3 comes news that Governor Jeb Bush has appointed Jason to the Florida Endowment Foundation for Vocational Rehabilitation (The ABLE Trust).

Jason, 31, succeeds James Smith PhD. His term will run for one year. The ABLE Trust is a government-created organization that helps "Floridians with disabilities fair employment opportunities through fundraising, grant programs, public awareness and education."

When he's not reviewing software and engaged in charitable work, Jason practices estate planning law at Havens & Miller, which has offices in Bluewater Bay, Destin, and New Orleans.

Nancy Smith Joins CaseSoft as Marketing Programs Manager

That lofty goal just took another step forward with the recruiting of Nancy Smith as Marketing Programs Manager.  In this newly created position, Nancy will oversee all of CaseSoft's marketing efforts. Edward Still Tapped for Voting Rights Act Anniversary

Forty years ago, President Johnson signed into law the Voting Rights Act, which abolished discriminatory barriers designed to limit minority participation in elections.

TechnoLawyer member and voting rights lawyer Edward Still served as a source for and was quoted in a recent article in the Tuscaloosa News commemorating the fortieth anniversary of the Voting Rights Act.

In particular, the article states: "Voting rights attorney Ed Still of Birmingham called the 1965 law that outlawed poll taxes and voting tests the first generation of laws needed to break the white hold on voter registration in Alabama and the South, where blacks often made up 25 percent of the population. 'The second generation of issues came in the early 1970s and those were over trying to dismantle at-large [election] districts,' Still said last week." Ellen Freedman Launches Law Practice Management Blog

Longtime TechnoLawyer member Ellen Freedman presides over Freedman Consulting, a legal technology consulting firm that primarily serves the Delaware and Lehigh Valley. On her site you'll find dozens of practice management articles she has penned for the Pennsylvania Bar Association where she serves as Law Practice Management Coordinator.

As if that weren't enough to keep her busy, Ellen recently launched Law Practice Management, a blog designed to "assist your firm in managing the business side of your practice." What makes Ellen's blog noteworthy is that she draws her material not from fellow bloggers, but from the lawyers she helps both at her consultancy and at the Pennsylvania Bar Association. You won't find much navel-gazing here, but rather genuinely helpful information.

George Elser Named a Fellow of the American College of Equine Attorneys

The American College of Equine Attorneys recently bestowed a prestigious Fellowship on TechnoLawyer member, George Elser. This honor requires, among other things, ten years of practice as an equine lawyer.

George had no problem fulfilling this and other requirements. He currently serves as Principal of Equine Dispute Solutions in Wayne, Pennsylvania. In this role, he mediates disputes involving horses and equine-related matters.

Over the years, George has dealt with virtually all matters involving horses, including ownership rights, breeding rights, boarding and training agreements, and liability when horses or people are injured. In addition to his legal and mediation work, he serves on the planning committee of and has frequently lectured at the annual National Equine Law Conference sponsored by the University of Kentucky in Lexington.

"My absolute favorite piece of technology — my fountain pen. It has served me well over the years, and is powered by a renewable energy source," joked George when asked about his favorite legal technology tools. "My two favorite technologies as everyone thinks of them today are my network and my backup system. I rest easily when they are both working," he added.
